These Terms of Use (the “Terms”) govern your access to and use of the website at https://clicksmith.ai (the “Site”), operated by Click Smith (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What the Site is

The Site describes our advertising and AI-visibility services and lets you contact us by phone or by requesting a call back. The Site itself does not sell products or take payments. Any services we provide to you are scoped and agreed separately — typically in a written proposal, statement of work, or services agreement — and those documents, not these Terms, govern the engagement. If there is a conflict between these Terms and a signed services agreement, the services agreement controls.

Eligibility

The Site and our services are intended for businesses and for individuals who are at least 18 years old. By using the Site, you represent that you meet these requirements.

Contacting you

If you submit the call-back form and check the consent box, you agree to receive calls and text messages from us at the number you provided, including via automated technology. Consent is not a condition of purchase, message and data rates may apply, and you can reply STOP to opt out of texts. See our Privacy Policy for details on how we handle your information.

Acceptable use

When using the Site, you agree not to:

• Submit false, misleading, or third-party contact information without authorization.
• Interfere with or disrupt the Site, probe or test its vulnerabilities, or bypass any security or access controls.
• Use automated means to scrape, harvest, or collect data from the Site beyond what standard search engines and AI crawlers do in the ordinary course.
• Use the Site for any unlawful purpose.

Intellectual property

The Site and its content — text, graphics, logos, and design — are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may view and share the Site for your own informational purposes, but you may not copy, modify, republish, or create derivative works from it without our written permission.

Third-party names and services

References on the Site to OpenAI, ChatGPT, Anthropic, Google, Perplexity, Meta, and other third parties are for identification only. We are not affiliated with, endorsed by, or sponsored by any of them, and their trademarks belong to their respective owners. Advertising platforms change their products, policies, and pricing at any time, and we have no control over those changes.

No guarantees; informational content

Content on the Site — including statements about ad platforms, auction dynamics, pricing, and timelines — is provided for general information, reflects conditions as we understand them at the time of writing, and may become outdated. It is not legal, financial, or investment advice. Advertising results depend on factors outside anyone’s control, and we do not guarantee any particular ranking, placement, traffic, lead volume, or revenue outcome.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Any dispute arising out of these Terms or the Site will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction. Either party may seek relief in small-claims court for qualifying disputes.

Changes to these Terms

We may revise these Terms from time to time. The current version will always be posted on this page with its effective date. Continuing to use the Site after changes take effect means you accept the revised Terms.
